Executive Order on Dyed Diesel Does Not Supercede State Law

Although President Donald Trump signed an Executive Order this week providing temporary tax relief for highway usage of dyed diesel fuel, it is important to be aware that this order does not supercede existing state fuel taxes or enforcement requirements. It currently remains illegal in New York State to use dyed diesel for on-road use.

NEDPA will continue advocating for state agencies to consider a change, but that change is not guaranteed. We will keep you informed if more information becomes available to us.
